BUYER The natural or legal person who provides their name, email, phone number, delivery and billing details when placing an order or starting a subscription. The Buyer's details, the product or service ordered and the amount payable are shown in the order summary. ARTICLE 2 – SUBJECT AND SCOPE 2.1. This Agreement sets out the rights and obligations of the parties, under Turkish Consumer Protection Law No. 6502 (the "Law") and the Distance Contracts Regulation (the "Regulation"), regarding the sale and delivery of the products and services that the Buyer purchases electronically on the Seller's websites, whose features and price are shown in the order summary. 2.2. This Agreement covers two kinds of sale: a) Physical products: products such as VivePad and its accessories, ordered on medroco.com and delivered by courier. b) Digital services: subscription packages purchased on membership.medroco.com that give access to the Medroco One platform and its applications and renew periodically. 2.3. Provisions specific to consumer law (in particular the right of withdrawal) do not apply to purchases the Buyer makes for commercial or professional purposes; all other provisions of this Agreement apply to such purchases. ARTICLE 3 – PRICE AND PAYMENT 3.1. The name, type, quantity and main features of the product or service, the price including VAT, any discounts, the shipping fee and the total amount payable are shown in the order summary. The order summary forms an integral part of this Agreement. 3.2. All prices include VAT. Payment is collected in Turkish lira; the Turkish lira amount shown on the payment screen is binding. 3.3. Payment is taken by credit or debit card through the infrastructure of iyzico, a licensed payment institution. Card details are entered only into iyzico's secure payment form; the Seller neither sees nor stores card details. 3.4. If a payment is found to have been made with a card that does not belong to the Buyer or without authorisation, the Seller cancels the order and refunds the amount collected to the cardholder. ARTICLE 4 – DELIVERY OF PHYSICAL PRODUCTS 4.1. Products are delivered by a contracted courier to the delivery address in Türkiye that the Buyer provides with the order. 4.2. Products are delivered within the period stated on the product page or in the order summary, and in any case within the statutory maximum of 30 (thirty) days from order confirmation. 4.3. If delivery of the ordered product becomes impossible, the Seller informs the Buyer within 3 (three) days of learning of it and refunds the full amount collected within 14 (fourteen) days at the latest. 4.4. Unless stated otherwise in the order summary, shipping within Türkiye is free of charge. 4.5. Order status and tracking information can be followed on the order tracking page on medroco.com and in the My Orders section of the Buyer's membership.medroco.com account. 4.6. Delivery is complete when the product is handed to the Buyer, or to a person the Buyer designates at the delivery address. Damage that occurs in transit is the Seller's responsibility. Refusing a damaged parcel or having the courier record the damage helps resolve the matter quickly. ARTICLE 5 – DIGITAL SERVICES (SUBSCRIPTIONS) 5.1. A subscription becomes active in the Buyer's account immediately upon payment confirmation (or, for packages with a free trial, when the trial starts). There is no physical delivery. 5.2. Unless the Buyer cancels, the subscription renews automatically for the same period at the end of the chosen billing period (monthly or yearly). The renewal fee is charged to the card stored with iyzico with the Buyer's consent. For packages with an introductory or discounted period, the amount that will apply after that period is shown separately on the purchase screen. 5.3. For packages with a free trial, the first charge is made at the end of the trial. If the Buyer cancels before the trial ends, nothing is charged. 5.4. The Buyer may cancel the subscription at any time in one step under membership.medroco.com > Profile > My Subscription. After cancellation no further charges are made and the Buyer keeps access until the end of the period already paid for. No partial refunds are given for a paid period. 5.5. If the subscription price changes, the Buyer is informed before the change takes effect. The new price applies from the first renewal after the notice. A Buyer who does not accept the new price may cancel before the renewal date. 5.6. If a renewal charge fails, the Buyer is informed and asked to update their card details. If payment cannot be collected, the subscription ends at the end of the paid period. 5.7. Subscriptions purchased inside the mobile apps through the App Store or Google Play are subject to the payment system and terms of that store. They can be cancelled and refunded only through the store's account settings. ARTICLE 6 – RIGHT OF WITHDRAWAL 6.1. For physical products, the Buyer may withdraw from the contract within 14 (fourteen) days of receiving the product, without giving any reason and without paying any penalty. For orders delivered in several parts, the period starts when the last item is received. The Buyer may also withdraw before the product is delivered. 6.2. It is sufficient to send a withdrawal notice within the period by email to [email protected] or in writing to the Seller's address. The notice need only state the Buyer's name, the order number and the wish to withdraw; the model withdrawal form in the Preliminary Information Form may also be used. 6.3. The Buyer returns the product, with its box and accessories, to the Seller within 10 (ten) days of sending the withdrawal notice. Return shipping is paid by the Seller; the return shipping details are sent to the Buyer by email. 6.4. The Seller refunds all amounts collected, including delivery costs, within 14 (fourteen) days of receiving the withdrawal notice, using the Buyer's original payment method and at no cost to the Buyer. For card payments, the time it takes for the refund to appear depends on the Buyer's bank. 6.5. The Buyer is not liable for changes or deterioration caused by using the product in line with its operation, technical specifications and instructions during the withdrawal period. The Buyer is liable for any loss in value caused by other use. 6.6. For digital services (subscriptions), under Article 15(1)(ğ) and (h) of the Regulation, the right of withdrawal does not apply to services performed instantly in electronic form, or to services whose performance begins with the consumer's consent before the withdrawal period ends. By confirming on the purchase screen, the Buyer requests that the service start immediately and accepts that there is therefore no right of withdrawal. The Buyer's right to cancel the subscription at any time (Article 5.4) is unaffected. 6.7. The right of withdrawal also does not apply to products made to the Buyer's specifications or personal needs, or in the other cases listed in Article 15 of the Regulation. ARTICLE 7 – WARRANTY AND DEFECTIVE PRODUCTS 7.1. Physical products carry a 2 (two) year warranty from the delivery date. Warranty claims can be made at [email protected]. Faults caused by use contrary to the user manual, impact, contact with liquids or unauthorised intervention are not covered. 7.2. If a product is defective, the Buyer may exercise one of the elective rights under Article 11 of the Law: withdrawing from the contract, a price reduction, free repair, or replacement with a non-defective equivalent. 7.3. If the digital service is interrupted or faulty, the Buyer may report it to [email protected], and the Seller will work to fix it within a reasonable time. ARTICLE 8 – OTHER PROVISIONS 8.1. The Buyer confirms that the information provided with the order is accurate and up to date. 8.2. Medroco products and services are intended for exercise, performance and progress tracking; they do not replace medical diagnosis or treatment. 8.3. Disputes arising from this Agreement fall within the jurisdiction of the Consumer Arbitration Committees at the Buyer's place of residence or where the transaction took place, up to the monetary limits announced each year by the Ministry of Trade, and of the Consumer Courts above those limits. For purchases where the Buyer is not a consumer, the courts and enforcement offices of Sakarya have jurisdiction. ARTICLE 10 – EFFECT Before completing the order or subscription, the Buyer confirms having read the Preliminary Information Form and accepts this Agreement electronically.
